Environmental Groups Challenge Government's Climate Policy

Environmental organizations Greenpeace and Germanwatch, with the support of over 54,000 co-plaintiffs, have filed a constitutional complaint against the government. They criticize the recent reforms to the Climate Protection Act, which they argue weaken climate policy by abolishing retroactive control through sectors and immediate programs.

The groups are demanding timely implementation of emission reductions to safeguard fundamental rights, referencing the Federal Constitutional Court’s 2021 climate ruling and the failure to meet the 2030 climate targets. A total of three complaints have been lodged by five German environmental associations.

They argue that the new monitoring mechanisms are inadequate and the emission reduction targets too weak. If these targets are not met, drastic measures such as high CO2 prices and driving bans, which disproportionately affect the socially disadvantaged, may become necessary.

The Federal Constitutional Court must now decide if the new law violates the freedom rights of future generations, as previously determined in 2021 and recently echoed by South Korea's Constitutional Court.
