Elon Musk's company X is facing nine privacy complaints after using data from EU users to train its Grok AI without consent. The Irish Data Protection Commission (DPC) and privacy group noyb have filed legal complaints, arguing that X lacks a valid 'legitimate interest' basis for the data use.
This comes after Meta paused a similar plan and a top EU court ruling that user consent is required for such data use. The DPC's response has been deemed insufficient by noyb, as there is currently no way for users to delete the data already ingested by X.
A Vienna-based group has also filed complaints in eight countries against X, accusing the company of unlawfully feeding data from over 60 million European users into its Grok AI technology without consent. The group has requested an 'urgency procedure' to prompt data protection authorities to take action.
Noyb, a digital rights NGO, has argued that the DPC is not adequately addressing GDPR compliance issues, including the lack of user consent, inadequate risk mitigation, and unclear plans for existing EU data in AI systems.
The involvement of more authorities is hoped to increase pressure on the DPC to fully enforce the case.
